A lawsuit for veterans' disability could be a solution for many veterans suffering from disabilities due to their military service. The Department of Veterans Affairs offers benefits to veterans, including medical care and special programs.

According to a lawsuit filed on Monday, Black veterans have disproportionately having a harder time in obtaining these benefits. The Yale Law School Veterans Legal Services Clinic filed the suit on behalf of Conley M. Monk Jr.

PTSD

Quil Lawrence of NPR reports that a VA whistleblower told the veterans that VA documents revealed that Black veterans Disability Lawyers were denied benefits in a higher proportion than white veterans.

The lawsuit was filed by Marine Vietnam veteran Conley monk and Yale's Veterans Legal Services Clinic. The lawsuit cites research that indicates that between 2001 and 2020 the rate of rejection for Black disability claims was 29.5 percent, as compared to 24.2 percent for white veterans disability attorney.

The lawsuit seeks compensatory damages for Monk and other Black veterans who were denied access to benefits. It is also seeking to force the VA to reconsider the thousands of other claims that were incorrectly dismissed. The lawsuit was filed this week in federal court.

Traumatic Brain Injury

TBI can be mild, moderate or severe and symptoms may be immediately apparent or they may develop in the hours or even weeks following the injury. The lawsuit says that racial bias in the military justice system impacted the discharge status of a lot of Black service members and VA officials should have known this when they made decision-making regarding disability compensation. The lawsuit cites a study which discovered that between 2001 and 2020 the average rate of denial for Black veterans who applied for disability compensation was 29.5 percent, compared with 24.2% for white veterans.
