A Veterans disability Lawsuit, trueandfalse.info, could be the solution for a large number of veterans suffering from disabilities resulting from their military service. The Department of Veterans Affairs provides benefits to those who have served in the military, such as medical care and special programs.

However, obtaining those benefits isn't easy for Black veterans, according to a new lawsuit filed Monday. The Yale Law School Veterans Legal Services Clinic filed the suit on behalf of Conley M. Monk Jr.

PTSD

If someone experiences trauma, it can cause them to develop symptoms of post-traumatic stress disorder (PTSD). The symptoms can include anxiety, nightmares, or frightening flashbacks. This condition can make an individual to avoid certain situations or places that trigger memories of their traumatic experience. This can cause individuals to feel isolated and depressed. Counseling, medication and support from family members can help to treat PTSD.

A new lawsuit brought by Black veterans and a Yale law clinic has found that the Department of veterans disability lawyer Affairs has been systematically denying disability compensation claims to Black vets for decades. Quil Lawrence of NPR reports that a VA whistleblower told the veterans that VA documents showed that Black veterans were denied benefits at a higher percentage than white veterans.

The lawsuit was filed by Marine Vietnam veteran Conley monk and Yale's Veterans Legal Services Clinic. The lawsuit cites data that show that between 2001 to 2020, the rejection rate for Black veterans of disability claims was rejected at 29.5 percent, compared to 24.2 percent of white veterans.

The lawsuit seeks compensatory damages for Monk and other Black veterans who were unfairly denied access to benefits. The lawsuit also seeks to make VA to review tens of thousands of claims that were denied in error. The lawsuit was filed this week in federal court.

Traumatic Brain Injury

TBI symptoms can be present immediately or appear for days, hours or even weeks later. Certain symptoms (headache dizziness, fatigue, headache) are physical, while others may include emotional, memory, concentration or behavioral issues. TBI patients might also experience problems with movement or vision and balance.

The brain injury due to a TBI can be caused by a bump, a blow or jolt to the head, whether it's from a force that is blunt or a penetrating injury (such as from a bullet). The impact can result in a skull fracture, which may result in bleeding and bruises of the brain inside the skull. The brain can swell and press against the skull, cutting off blood circulation. The injury could occur throughout the entire brain or in the lobe in which it is located.

Certain TBIs are classified as open, while others are closed. The classification is based on whether or not the skull has been broken and whether the skull was closed or opened due to the impact. TBIs vary in severity, ranging from concussions all the way to death. People with TBI are at increased risk of developing depression, PTSD and other mental health conditions. Research suggests that having multiple moderate to severe TBIs may increase the risk of developing dementia and movement problems in later years.

Post Traumatic Stress Disorder

Post-traumatic stress disorder (PTSD) is a condition that occurs when the victim experiences trauma. It can be apparent immediately following the event, or may develop years later. Memory issues, trouble sleep and concentration, feelings of anger or irritability, and being easily triggered are a few of the symptoms. Certain people may be depressed or suicidal. The PTSD condition can cause issues at work, with relationships, and at home. It can also cause dependence, which includes alcohol or drug.

Psychotherapy can treat symptoms such as eye movement desensitisation (EMDR) and cognitive processing therapy. Antidepressants, such as selective Serotonin Reuptake Inhibitors (SNRIs) are beneficial for those suffering from PTSD. The medications can help manage the symptoms and make it easier to get through everyday activities.

Some research is exploring how to prevent PTSD and examining whether the brain or genes may affect a person's reaction to trauma. Other researchers are looking into the ways in which a normal stress response develops into PTSD and how to treat it in the early stages.

It is essential to consult your doctor if you suffer from PTSD. Symptoms that interfere with daily life, such as difficulties getting along with others or feeling angry and annoyed should be addressed immediately. Self-help may be helpful for those suffering from PTSD. They may benefit from discussing their experiences during therapy, or practicing relaxation exercises like deep breathing and rhythmic exercise. They can also benefit by being able share their fears with a trusted person.

Depression

Depression is a condition that can cause feelings of despair and sadness. It can be treated through psychotherapy. It involves speaking with a therapist about the issues that are causing your problems. You could be prescribed medication to help improve your mood. There are numerous types of therapy. Cognitive behavioral therapy aids you to alter negative thoughts and behaviors, while interpersonal therapy focuses on relationships. There are also group therapies that bring people with the same condition together in a safe and supportive setting.

The lawsuit claims that the VA has discriminated against Black veterans for years, through a disproportionate refusal of disability compensation claim in a higher proportion than white veterans. It was filed on behalf of Conley Monk who is an Vietnam War veteran who tried to obtain medical benefits, housing assistance and education benefits for 50 years. The lawsuit is being handled by Yale Law School’s Veterans Legal Services Clinic. Monk was represented in his successful bid to rescind his unhonorable discharge from the military because of PTSD and other injuries.

The lawsuit claims that racial discrimination within the military justice system impacted the discharge status of Black service members and VA officials should've known this prior to making decisions regarding disability compensation. The lawsuit cites a study that found that, between 2001 and 2020 the average denial rate of Black veterans who applied to receive disability compensation was 29,5% in contrast to 24,2% for white veterans.
